We draft customised documents tailored to suit our client’s business, including customised employment contracts, individual flexibility agreements, consultancy agreements, enterprise agreements and workplace policies.
LITIGATION
We appear for employers before all courts and industrial tribunals in all types of employment related litigation. We regularly act in general protection and bullying claims, proceedings to enforce post-employment restraints, proceedings to recover confidential information and sexual harassment, discrimination and unfair dismissal claims.
WORKPLACE INVESTIGATIONS
We regularly conduct workplace investigations. We interview staff, prepare a report setting out findings and advise management with respect to handling those findings and staff. In other instances, we provide behind-the-scenes support to ensure the investigation process operates smoothly and our client is protected.
COMPLIANCE
We have considerable experience advising about the Australian regulatory system and its impact on employers. We regularly provide advice on award coverage and compliance and the application and operation of the Fair Work Act. We assist employers navigate their employment related obligations under the Corporations Act and the ASX Listing Rules, including in relation to executive termination arrangements and the limits on executive termination payments.
Enterprise Agreements
We assist employers cut through the red tape to draft and negotiate their enterprise agreements.
Training
We offer interactive, engaging and practical training programs designed to educate and protect our clients’ business. We offer training across a wide range of topics including harassment, discrimination, bullying, work health and safety and performance management.
Work, Health and Safety (WHS)
We advise on compliance with WHS laws. We prepare WHS policies, conduct training in relation to their obligations under WHS laws and represent employers in WHS related prosecutions.
Employment aspects of business mergers and acquisitions
We advise businesses with respect to the employment aspects of mergers and acquisitions, listings, de-listings and transfer of business. We will draft the employment sections of the due diligence report and transaction documents, advise on the transfer on industrial instruments and work closely with our clients to manage all employee related issues and communications both pre and post completion.
